This privacy policy governs your use of the software application AgriPay (“Application”). The Application is intended for timetracking and payroll integration for agriculture businesses. AgriPay is owned and operated by Integrated Labor Solutions LLC


WHAT INFORMATION DOES THE APPLICATION OBTAIN AND HOW IS IT USED?


Information We Obtain

We may obtain consumer personal information (such as name, contact details and payment information) in connection with various activities such as use of the Agri-Pay websites and applications. The types of personal information we may obtain includes:

  • Individual and business contact information (such as name, company name, physical address, email address, and telephone or fax number)
  • Username, password and other credentials used to access Agri-Pay products and services.
  • The geographic location of you or your employee or contractor’s mobile device if you use certain features of our apps.
  • Payment information (including payment card details or online payment services number and billing address) and financial information (such as bank account number).
  • Tax identification number in circumstances in which you request products or services for which this information is required, or in connection with certain promotions or sweepstakes.
  • Other personal information that may be provided to us to obtain a Agri-Pay product or service.
  • Identifying information of your employees and contractors.

In addition, when you visit our websites, use our apps, or interact with Agri-Pay-related tools, widgets or plug-ins, we may collect certain information by automated means, such as cookies and web beacons. The information we collect in this manner includes IP address, unique device identifier, browser characteristics, device characteristics, operating system, language preferences, referring URLs, information on actions taken, and dates and times of activity. A "cookie" is a text file that websites send to a visitor's computer or other Internet-connected device to uniquely identify the visitor's browser or to store information or settings in the browser. A "web beacon" also known as an Internet tag, pixel tag or clear GIF, links web pages or apps to web servers and may be used to transmit information back to a web server. Through these automated collection methods, we obtain and store "clickstream data" to tell us usage patterns. We may link certain data elements we have collected through automated means, such as your browser information, with other information we have obtained about you to let us know, for example, whether you have opened an email we sent to you. We also may use third-party analytics tools that collect information about visitor traffic on our websites or apps. Your browser may tell you how to be notified when you receive certain types of cookies or how to restrict or disable certain types of cookies. Please note, however, that without cookies you may not be able to use all of the features of our websites or apps. Both we and others (such as our advertising networks) may collect personal information about our visitors' online activities, over time and across third-party websites, when using our websites and apps.

The providers of third-party apps, tools, widgets and plug-ins on our websites and apps, such as Facebook "Like" buttons, also may use automated means to collect information regarding your interactions with these features. This information is subject to the privacy policies or notices of these providers.

User Provided Information

The Application obtains the information you provide when you (1) download and register the Application and (2) create user accounts on the web application. When you register with us and use the Application, you generally provide (a) your name, email address, age, user name, password and other registration information which may be personally identifiable; (b) transaction-related information, such as when you make purchases, respond to any offers, or download or use applications from us; (c) information you provide us when you contact us for help; (d) credit card information for purchase and use of the Application, and; (e) information you enter into our system when using the Application, such as contact information and project management information.

We may also use the information you provided us to contact your from time to time to provide you with important information, required notices and marketing promotions.

Automatically Collected Information

In addition, the Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application. Do third parties see and/or have access to information obtained by the Application?

Currently, no third parties have access to information obtained by the Application. If that changes in the future, only aggregated, anonymized data may be periodically transmitted to external services to help us improve the Application and our service. We will share your information with third parties only in the ways that are described in this privacy statement.

We may disclose User Provided and Automatically Collected Information:

  • as required by law, such as to comply with a subpoena, or similar legal process;
  • when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;

How We Use the Information We Obtain

We may use the information we obtain to:

  • Provide products and services you request (such as logistics, supply chain management, customs clearance and brokerage services, and financial services).
  • Process and collect payments.
  • Provide customer support and respond to and communicate with you about your requests, questions and comments.
  • Establish and manage your Agri-Pay account.
  • Offer you products and services we believe may interest you.
  • Send information to your contacts if you ask us to do so.
  • Process claims we receive in connection with our services.
  • Operate, evaluate and improve our business (including developing new products and services; managing our communications; determining the effectiveness of our sales, marketing and advertising; analyzing and enhancing our products, services, websites, and apps; and performing accounting, auditing, billing, reconciliation and collection activities)
  • Perform data analyses (including market and consumer search, trend analysis, financial analysis, and anonymization of personal information)
  • Protect against, identity and prevent fraud and other criminal activity, claims and other liabilities.
  • Comply with applicable legal requirements and our policies

In addition, we use information collected online through cookies, web beacons and other automated means for purposes such as (i) customizing our users' visits to our websites and apps, (ii) delivering content (including advertising) tailored to our users' interests and the manner in which our users browse our websites and apps, and (iii) managing our business. We may supplement data we collect through automated means with information about your location (such as your ZIP or postal code) to provide you with content that may be of interest to you. We also use this information to help diagnose technical and service problems, administer our websites and apps, identify users of our websites and apps, and gather demographic information about our users. We use clickstream data to determine usage patterns and how we may tailor our websites and apps to better meet the needs of our users. Our websites and apps are not designed to respond to "do not track" requests from browsers.

Information We Share

We do not sell or otherwise share personal information about you, except as described in this Privacy Notice.

We also may share the personal information we obtain with our affiliates, franchisees, resellers and joint marketing partners. These entities, which collectively are referred to here as the "Agri-Pay Business Partners," may use the information for the purposes described in this Privacy Notice. We may share physical location data with our Agri-Business Partners and other third parties to enhance services.

Information collected through third-party apps, tools, widgets and plug-ins (such as information obtained through third-party login services or relating to your use of a Facebook "Like" button) is collected directly by the providers of these features. This information is subject to the privacy policies of the providers of the features, and Agri-Pay is not responsible for those providers' information practices.

We also may disclose information about you (i) if we are required to do so by law, regulation or legal process (such as a court order or subpoena), (ii) in response to requests by government agencies, such as law enforcement authorities, or (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity. We reserve the right to transfer any information we have about you in the event we sell or transfer all or a portion of our business or assets (including in the event of a reorganization, dissolution or liquidation).

What are my opt-out rights?

You can stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network. You can also request to opt-out via email.

Data Retention Policy, Managing Your Information

We will retain User Provided data for as long as you use the Application and for a reasonable time thereafter. We will retain Automatically Collected information for up to 24 months and thereafter may store it in aggregate. If you’d like us to delete User Provided Data that you have provided via the Application, please contact us via email and we will respond in a reasonable time. Please note that some or all of the User Provided Data may be required in order for the Application to function properly.

Non-Agri-Pay Places and Services

For your convenience and information, our websites and apps may contain links to non-Agri-Pay places that may be operated by companies not affiliated with Agri-Pay. These companies may have their own privacy policies or notices, which we strongly suggest you review. Our services also may be made available to you through third-party platforms (such as providers of app stores) or through other third-party channels. We are not responsible for the privacy practices of any non-Agri-Pay places or services.

Data Transfers

We may transfer the personal information we collect about you to countries other than the country in which the information originally was collected. Those countries may not have the same data protection laws as the country in which you initially provided the information. When we transfer your information to other countries, we will protect that information as described in this Privacy Notice and in accordance with applicable law. We use contractual protections for the transfer of personal information among various jurisdictions (including, for example, the European Commission's standard contractual clauses).

Children

We do not use the Application to knowingly solicit data from or market to children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us via email. We will delete such information from our files within a reasonable time.

Security

We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Application. Please be aware that, although we endeavor provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

Changes

This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy here and informing you via email or text message. Your Consent

By using the Application, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. “Processing,” means using cookies on a computer/hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in the United States. If you reside outside the United States your information will be transferred, processed and stored there under United States privacy standards.

Updates to Privacy Notice

This Privacy Notice may be updated periodically and without prior notice to you to reflect changes in our personal information practices. We will post a prominent notice on our websites to notify you of any significant changes to our Privacy Notice and indicate at the top of the notice when it was most recently updated.
